The Shelburne Historical Society has a significant collection of historical photographs, documents and artifacts relevant to the town of Shelburne.

The following policy has been approved by the Society's Board of Directors to ensure the ongoing preservation of the collection and to encourage its fair use. All requests to deviate from this policy must be made in writing to the Society.

Photographs and Documents

Copy prints of photographs and negatives, and photocopies of documents, are available for purchase. Patrons must pay for the cost of their copies, as well as a publication fee if the copy print or photocopy will be published (price list below). Fees paid to the Society support the preservation of the photograph and document collection.

Original photographs and documents do not leave the Society's hands. Society staff will make the copy print or photocopy from the original photograph or document, or from a negative if one is available.

All negatives produced in the course of making copy prints are the property of the Society. Orders for copy prints or photocopies must be prepaid. Most orders can be filled within four weeks.

Copying of photographs and documents will normally be done upon request by Society staff. Patrons may visit the Museum during open hours to select for themselves the photographs and/or documents they wish to have copied, or they may request copies by mail, telephone, or email (address above). If the Society's staff needs to do research, answer queries or search for materials, patrons will be charged an hourly fee for this service (price list below).

The Society does not have facilities suitable for photocopying more than a few pages. For sizeable photocopying tasks, patrons will be charged a page fee plus an hourly charge for staff time, including travel time to a suitable copy center (prices quoted upon request).


Photographing Artifacts

Patrons may freely photograph artifacts on display in the Museum during the Museum's open hours, provided no special equipment or staff assistance is required. Please contact the Society if the services of a photographer are desired. For publishing photographs of Museum artifacts, the same restrictions apply as for copies of photographs and documents in the Society's collection.

Private Use Requests

Patrons may freely use the prints or photocopies that they purchase, or their own photographs of Museum artifacts, for their own research or non-commercial display. Patrons who do not intend to publish the materials that they purchase are required to sign a form (below) stating that the materials are for their private use. Patrons assume legal responsibility for compliance with copyright laws.

Requests for Publication

The Society is pleased to work with patrons who wish to publish the copies of photographs and documents that they purchase from the Society. Publications are an important way that the public learns about the Shelburne Historical Society. This is one of the reasons why the Society retains control over where and how its photographs and documents appear.

 Whether the product is a book, a videotape, a CD-ROM, an electronic copy on the Internet, a wall display in a commercial setting, an advertisement or some other publication, patrons must receive prior written permission to publish copies of photographs or documents from the Society's collection. The same restriction applies to photographs of artifacts in the Museum, whether photographed by the patron, by a Society staff member, or a professional photographer.

 Published photographs or photocopies must accurately reflect the originals in the Society's collection. For this reason, no copy of a photograph or document may be digitally altered, except for standard techniques to improve contrast and resolution. Photographs may be cropped to change their proportions, but the cropping should not eliminate details that are historically significant. A cropped image must be labeled "detail." Partial photocopies of documents, as well as transcriptions and abstracts, should be labeled as such. Any omissions, or changes from the exact wording and spelling of the original document, should be indicated.

Patrons assume legal responsibility for violating confidentiality, in particular publishing information about living persons without their permission.

A Request for Permission to Publish (below) must be submitted in writing to the Society. This request must clearly explain the intended use of the photograph or document. Therefore, it should identify the photograph or document and include such details as the title of the publication, the subject of the publication, the names of the author(s) and publisher, and the year of publication. The Request must be signed and dated.

Permission to publish, if granted, will be given in writing by the Secretary of the Society. In the publication, the copy should be accompanied by the following text: "[donor name, if applicable], Courtesy of the Shelburne Historical Society, Shelburne Falls, Mass."

When permission to publish is given, it is for the one-time North American publication or public presentation of a photograph or document in the Society's collection. Each reprinting or repeat presentation of the photograph or document requires a new Request for Permission to Publish.

The Society must receive a complimentary copy of any publication in which a photograph or document from the Society's collection is used. This copy should be sent immediately after publication, without being specifically requested by the Society. If publication is not completed within one year after the materials are received from the Society, a publication status report must be provided to the Society.
